Protecting children's rights: A comparative analysis between Vietnam and the legal models of the European Union and Hungary

Abstract

The dissertation has analyzed the legal regulations related to children's rights in Vietnam. Based on this, a comparison is made with the legal framework in Europe and Hungary. The author's analysis focuses on four rights of children: the right to birth registration, the right to education, the right to privacy, and the right to protection from violence. This choice is derived from the practical situation in Vietnam as well as the need to develop proposals to improve child protection. The dissertation is structured into 6 chapters. Chapter 1 introduces some basic concepts, provides an overview of the research literature, and discusses research methods. The research objectives and scope are also identified in this chapter. Chapter 2 explores the formation and development of the concept of children's rights and the protection of children's rights in Vietnamese law from ancient times to the present day. Chapters 3 and 4 analyze the principles of child protection and some children's rights within the scope of the research from the perspectives of international law and Vietnamese law. Chapter 5 analyzes the principles of child protection and children's rights according to the legal framework in Europe and Hungary. Chapter 6 clarifies the remaining limitations in protecting children's rights in Vietnam today from both legislative and law enforcement perspectives. Solutions are then proposed to achieve the research objectives identified by the author.
